Maintenance is the continued financial support of one spouse by the other. Support is commonly known as alimony, but in the State of Missouri alimony is called maintenance.
Maintenance generally takes the form of either:
- temporary maintenance
- permanent maintenance
As the term implies, temporary maintenance is support provided for a fixed, finite amount of time. Permanent maintenance is support that is ongoing until the spouse remarries, dies or the court determines that support is no longer needed.
Similar to child support, maintenance has established guidelines to help the court determine when and how much maintenance a spouse should receive. A variety of factors help determine the amount of maintenance, including:
- financial resources of both parties
- standard of living established in the marriage
- how long the couple was married
- time needed to educate or train the spouse to gain employment
- age, health and emotional status of the spouse seeking maintenance
